The Lagos State Court of Appeal on Tuesday declared the Labor Party (LP) candidate, Thaddeus Atta, as the duly elected Member of the House of Representatives representing Eti Osa Federal Constituency.
Recall that the National Assembly Elections Tribunal, which sits at Tafawa Balewa Square in Lagos, had in September declared the election as inconclusive.
The tribunal ordered the Independent National Electoral Commission (INEC) to hold supplementary elections at 33 polling stations within 90 days.
INEC was also ordered to revoke the certificate of return issued to Attah and hold elections in areas where elections did not take place on February 25.
However, in its ruling on Tuesday, the Court of Appeal quashed the tribunal’s directive and ruled that the election was decisive.

Following the court ruling, Thaddeus Attah named famous Nigerian singer and Peoples Democratic Party (PDP) candidate Bankole Wellington, popularly known as Banky W, who came second in the February 2023 elections, and Ibrahim Babajide Obanikoro, the candidate of the People’s Democratic Party, defeated. All Progressive Congress (APC).
