Breaking: Supreme Court reverses sacking of Kano Governor Abba Yusuf

In a unanimous ruling on Friday, a five-judge panel of the apex court quashed the concurrent judgments of the Court of Appeal in Abuja and the Kano State Governorship Election Petitions Tribunal, which had dismissed Governor Yusuf and named All Progressive Congress, APC, candidate . Nasiru Gawuna as winner of the governorship contest.

The Supreme Court, in the main decision delivered by Justice Inyang Okoro, ruled that the two lower courts had wrongly deducted the legitimate votes given to Governor Yusuf by the Independent National Electoral Commission, or INEC.

It concluded that the 165,663 votes deprived of Yusuf and the NNPP because the ballots had no signature, seal or date were legitimate.

Contrary to the lower courts' rulings, the court determined that 146,292 ballots had been verified as signed and postmarked; the only difference was that they had no date.

It concluded that ballot papers officially marked and duly provided by INEC were not wholly invalid under section 63(1) of the Electoral Act 2022.

Furthermore, the court ruled that there was no evidence that Governor Yusuf had any influence over the ballots that were not required to be signed.

Furthermore, the court criticized the lower courts for invalidating Yusuf's election on the grounds that he was not an NNPP member.

It ruled that the internal activities of a political party include the sponsorship of a candidate in elections.
